Terms of Service

These terms govern your use of hostbyras.com and the services provided by Rudy's AI Systems & Integrations ("RAS," "we," "us"). By using this site or our services, you agree to these terms. A separate signed service agreement, where one exists, takes precedence over this page.

1. What we provide

RAS builds, hosts, and supports websites, AI phone receptionists, online booking, customer dashboards, messaging, and related integrations for local businesses. The specific features, plan, and price for a client are set out in that client's order or service agreement.

2. Plans, billing & cancellation

• Services are billed as a one-time setup fee plus a recurring monthly fee, as quoted.
• Monthly fees are billed in advance and are non-refundable for the period already begun, unless required by law.
• No long-term contract — clients may cancel with notice as stated in their agreement; service continues to the end of the paid period.
• Prices shown on this site are current offerings and may change; existing clients are notified before a change affects them.

3. Client responsibilities

• Provide accurate business information and keep contact details current.
• Own or have the right to use any logo, photo, text, or other material you give us to publish.
• Use the services lawfully — including complying with rules that apply to calling and texting your customers, and to your own industry.
• Keep account credentials secure.

4. AI receptionist — what it is and isn't

The AI receptionist answers calls, provides information you approve, and books, reschedules, or cancels appointments. It is an automated system: it can make mistakes, mishear, or fail to complete a request. It is not a substitute for professional, medical, legal, or emergency assistance, and it must not be used to provide emergency services. Calls involving emergencies or complex matters should be routed to a human. Clients are responsible for reviewing the information the assistant is configured to give.

5. Payments to our clients (Stripe)

Where a client uses invoicing or takes payments from their own customers, those payments are processed through the client's own payment provider account (for example, their own Stripe account). Funds go directly to the client. RAS does not hold, control, or take custody of those funds and is not a party to that transaction.

6. Third-party services

Our services rely on third parties including hosting, telephony, messaging, voice AI, and payment providers. Their availability and terms are outside our control, and interruptions in their service may affect ours.

7. Intellectual property

You keep ownership of your business content, logos, and customer data. RAS retains ownership of its own software, templates, configurations, and tooling. While your account is active and paid, you have a license to use the deliverables we build for you for your business.

8. Availability

We work to keep services running reliably but do not guarantee uninterrupted or error-free operation. Maintenance, third-party outages, and events beyond our control may cause downtime.

9. Disclaimers & limitation of liability

Except where prohibited by law, services are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, RAS is not liable for indirect, incidental, special, or consequential damages, or for lost profits, lost business, or lost data. Our total liability for any claim is limited to the amount you paid us for the service in the three (3) months before the claim arose.

10. Indemnity

You agree to indemnify and hold RAS harmless from claims arising out of the content you supply, your use of the services, or your violation of law or these terms.

11. Termination

Either party may end the relationship as described in the applicable agreement. We may suspend or terminate service for non-payment, unlawful use, or abuse. On termination we will make reasonable efforts to provide a copy of your business data on request.

12. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Venue for disputes lies in the state or federal courts serving San Bernardino County, California.

13. Changes

We may update these terms; the "last updated" date reflects the current version. Continued use after an update means you accept the revised terms.
